1) Acceptance of These Terms
By accessing or using the Site, purchasing services, creating an account, or booking classes, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site or services.
2) Services; Not Medical Advice
TURF provides fitness training and related services. Information on the Site is for general informational purposes only and is not medical advice. Consult a physician before beginning any exercise program, especially if you have any medical condition or injury.
3) Eligibility
You must be at least 18 years old to create an account or purchase services, unless a parent or legal guardian provides consent and executes any required waivers for a minor.
4) Accounts and Accuracy
You agree to provide accurate information, keep it updated, and maintain the confidentiality of your account credentials. You are responsible for all activity under your account.
5) Purchases, Memberships, and Payments
• Billing Authorization: You authorize TURF (and our third-party payment processors) to charge your payment method for purchases, memberships, recurring plans, fees, and applicable taxes.
• Auto-Renewal (if applicable): Memberships or plans that recur will renew automatically until canceled in accordance with the terms presented at purchase and within your account settings (if available).
• Price Changes: We may change pricing and offerings from time to time. Where required, we will provide notice before changes take effect.
6) Class Reservations, Late Arrivals, and No-Shows
Class policies may vary by program and may be communicated at purchase, on the Site, or in your booking platform.
• Reservations may be required.
• Late arrivals may be denied entry for safety and to preserve class flow.
• No-shows and late cancellations may result in a fee and/or loss of class credit.
7) Cancellations and Refunds
Unless a different policy is provided at the time of purchase:
• Refunds: Purchases are generally final. Unused sessions may expire.
• Exceptions: We may make exceptions at our discretion or where required by law.
Your specific membership and package terms (including cancellation windows, expiration, freezes, and fees) are the terms displayed at checkout and/or within your membership agreement/booking platform.
8) Facility Rules and Conduct
You agree to follow all posted rules and staff instructions, including safety procedures, equipment use, hygiene standards, and respectful conduct. We may refuse service, suspend, or terminate access for unsafe, disruptive, abusive, or unlawful behavior.
9) Assumption of Risk; Release of Liability
Fitness activities involve inherent risks, including serious injury, illness, or death. By participating in any TURF activity (classes, open gym, events, or remote programming), you voluntarily assume all risks (known and unknown), including risks arising from physical exertion, equipment, facilities, instruction, and other participants.
To the maximum extent permitted by law, you agree that TURF is not responsible for injuries except to the extent caused by TURF’s gross negligence or willful misconduct. If you sign a separate waiver/release, that document may control in the event of any conflict.
10) Indemnification
You agree to defend, indemnify, and hold harmless TURF and its owners, employees, contractors, and agents from claims, damages, liabilities, and expenses arising from your misuse of the Site or services, your violation of these Terms, or your violation of law, except to the extent caused by TURF’s gross negligence or willful misconduct.
11) Intellectual Property
The Site and its content (including logos, branding, text, images, videos, and programming) are owned by TURF or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or exploit any content without prior written permission.
12) User Content; Reviews; Testimonials
If you submit content (reviews, testimonials, photos, videos, comments), you represent you have the necessary rights to do so and grant TURF a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for business and marketing purposes.
13) Photography and Video in the Facility
TURF may capture photos or video in classes or events for marketing, training, and operational purposes. If you do not want to appear, email info@turfnb.com in advance and notify staff at check-in. We will make reasonable efforts to accommodate, but we cannot guarantee exclusion from incidental background capture.
14) Third-Party Services
We may use third-party providers (e.g., scheduling/booking, payment processing, email/SMS messaging, analytics). Your use of third-party services is governed by their terms and privacy policies. TURF is not responsible for third-party services.
15) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURF WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE. TURF’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO TURF IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
17) Governing Law; Venue
These Terms are governed by California law, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Orange County, California, and you consent to jurisdiction and venue there.
18) Changes to These Terms
We may update these Terms from time to time. The Effective Date will be revised. Continued use of the Site or services after updates means you accept the revised Terms.
